PURCHASER'S DUTIES
It is expressly forbidden to provide false data and / or use the identity of another person in the registration process essential for the execution of the sales contract and related communications. The name and e-mail address provided by the user must be real and all data must be true and up to date.
In case of orders placed through the site www.nonncalabrese.it, it is mandatory to read and accept the Terms and Conditions before sending a purchase order. Acceptance will be made by registering the relevant profile on the website. If acceptance is not given, the order cannot be completed.
TERMS OF DELIVERY
The delivery of the goods, ordered directly from Nonna Calabrese, will be delivered by courier, operated in collaboration with the best national and international couriers. Delivery times depend on the country of destination of the goods. In the case of orders in Italy, delivery will be made within 2/3 working days from receipt of the order. In case of orders placed in Europe, delivery will probably be within 3/4 working days. In the event of delivery delays due to force majeure and / or occasional events, Piedmontdelights.com customer service will promptly inform the customer.
DELIVERY COST
In Italy, for orders under €49.99, the shipping cost is €7.99. Delivery will be free for orders over €49.99.
In Europe, for orders under €129.00, the shipping cost is €9.90. Delivery will be free for orders over €129.00.
TERMS OF PAYMENT
The payment methods accepted for orders are by credit card, PayPal and/or bank transfer.
RETURN POLICY
In case you receive a damaged package, please make sure the products inside are not.
In case they are (broken bottles, open food boxes), please take a photo and send it to digicalfoodsrl@gmail.com, we will evaluate the problem and if the damages were caused by us (or the couriers), we will send them back for free.
In case of a missing product within the shipment, or a broken or expired product, please notify us within 7 days from the date of receipt of the order. In case of failure to notify, no complaints will be accepted after the indicated period.
TRACEABILITY OF SOLD PRODUCTS
On all the products managed by Nonna Calabrese and especially those regulated by regulations, the total traceability of the items sold is guaranteed.
PACKAGING DETAILS
We ship the products in thermal bags, with dry ice for food, they will keep the products fresh even after 72 hours. Most of the products, especially cheeses and cured meats, are shipped vacuum packed.
Since some cured meats and other products are seasoned, vacuum packing is not necessary, but they will still be packaged and placed inside thermal bags for greater safety.
The thermal envelopes will then be placed inside sealed cardboard boxes.
In case of large orders, they will be shipped in several separate containers – it will of course be counted as 1 shipment even if there are multiple boxes.
PRODUCTS
The images of the products and the information contained in the information sheets correspond to the real characteristics of the products, as indicated by the Manufacturer or by the Supplier to the Seller. It is understood that any discrepancy between what is published on the site www.shopiemonte.com and reality will not be attributable to Nonna Calabrese (Digical Food SRL), which will not be responsible for the truthfulness of the information provided by the Producer or Supplier. The photographs presenting the products and the technical data sheets will not be an integral part of the contractual framework and can in no case be considered as the responsibility of Shopiemonte srl. The technical data sheets and images of the products are made available by the Producers and Suppliers therefore Nonna Calabrese will decline any responsibility regarding the content of the same and the actual correspondence with the reality of what is described therein. The products will not be supplied on a trial basis. The Customer will be responsible for choosing the products ordered. The information provided on or through this site should be used for general information purposes only and not as a substitute for any form of advice. Decisions based on this information are made by the user at his own risk and for his own account. No rights can be derived from the information contained on this site. Nonna Calabrese provides accurate, complete and updated information, however, does not guarantee the information obtained on the site www.nonncalabrese.it because they were provided by third parties.
BILLING
The invoice will be issued as soon as the order is completed. Nonna Calabrese (and Digical Food SRL) will issue an invoice with the amount of the order placed. By accepting the general conditions of sale, the Customer accepts and authorizes the processing and communication of the related data.
PAYMENTS IN ELECTRONIC FORM
Payments made by credit card, or other electronic forms, will be made through a secure connection, relying on the Visa, Mastercard and Pay Pal services. The Customer will pay for the purchases with the Credit Card without sharing the financial information with Digical Food SRL which therefore cannot be held responsible for any fraudulent use of the card in question. PROBLEMS IN NAVIGATION OF THE SITE
The Customer must autonomously equip himself with equipment and programs suitable for connection to the Internet. If the Customer is no longer able to view part or all of the site www.nonncalabrese.it no charge or liability can be attributed to Digical Food SRL. Digical Food SRL does not guarantee that the site www.nonncalabrese.it will function without errors or interruptions. Uses of this website that could prevent its use by other Internet users, impair its functionality and/or affect the information provided on or through the site or the underlying software are prohibited. Digical Food SRL will not be held responsible for any damage, direct or indirect, deriving in any way from access to this site and/or (from the use of) information provided on the site or through it. Digical Food SRL reserves the right to modify the information provided by the site www.nonncalabrese.it or through it, including the terms of this Disclaimer, at any time and without notice. Digical Food SRL will not be held responsible for the content of external websites that have a link to this site or that refer to this site.
RESOLUTION
The parties will have the right to terminate the order contract with immediate effect in the event of non-fulfillment, even partial, of the obligations arising on the part of the counterparty by means of written communication to be sent to the same by registered letter with return receipt. Digical Food SRL also reserves the right to refuse any other subsequent order from the defaulting Customer, also reserving the right to take legal action to protect its rights.
MAJOR FORCE
Digical Food SRL will not be held responsible towards the Customer for delays or failure to perform contractual obligations caused, directly or indirectly, by force majeure events beyond its control, such as for example: natural phenomena of particular intensity, war events, strikes, unforeseen restrictions ordered by the authorities, etc. In such cases, the interested party will promptly notify Digical Food SRL of the event. In any case of force majeure, the parties will be entitled to cancel the order contract or request its execution within a term to be fixed.
LIMITATIONS OF LIABILITY
Digical Food SRL assumes no responsibility for disservices attributable to force majeure which prevented, in whole or in part, the execution of the sales agreement within the agreed times. Digical Food SRL will not be liable to any party in regarding damages, losses and costs incurred following the non-execution of the sales agreement for the reasons mentioned above, or regarding damages, losses and costs incurred following the use or impossibility of using the purchased products, having the Customer only entitled to a refund of the price paid, excluding any shipping costs. Digical Food SRL cannot be held responsible for the loss or damage suffered by the Customer due to delays, slowdowns and interruptions of the e-commerce service, if these events do not depend on his own conduct or are caused by the malfunctioning of the telecommunications services. Digical Food SRL cannot be held responsible for delays in the execution of the purchase order or for the non-execution of the same, if such situations were caused by impediments beyond its control. The description of the products on the site is for purely commercial purposes and does not imply any acknowledgment and certification of the actual effectiveness of the products. Furthermore, Digical Food SRL does not guarantee the real validity and usefulness of the products on the site and therefore cannot be held responsible for the non-occurrence of the effects indicated in the descriptions and/or on the packaging. Digical Food SRL is not responsible for damages caused by the improper use of the products on the site.
SERVICE SUSPENSION
Digical Food SRL reserves the right to suspend the visibility of the site in all or even only in part of its functions in relation to all the needs connected to the efficiency and safety of the same. In these cases Digical Food SRL, except for reasons of particular urgency, will notify the customers by any means deemed suitable and as soon as possible.
JURISDICTION AND GOVERNING LAW
The sales contract between Digical Food SRL and the Customer is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this remote sales contract, the territorial jurisdiction will be exclusively that of the Court of Novara.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the General and Payment Conditions. Therefore, pursuant to articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have carefully read the above General Conditions in all its points and, after careful re-reading, to expressly accept all the points.
